Malawi’s latest salacious scandal involves the highest office in the country. The manner in which President Peter Mutharika kissed his wife, Gertrude Mutharika during a much publicized Democratic Progressive Party Valentine’s day fundraising dinner has caused quite a stir in Malawi and on social media.

The event took place on Saturday, February 14th, 2015 in Lilongwe. Dawned in a black Chinese collar suit with a red bow tie, Mutharika presented a bouquet of flowers to his wife in celebration of Valentines Day. Then after being coaxed by the event’s host, he kissed the First Lady who was clad in a red dress in front of attendees and television cameras who were broadcasting the event to the entire nation.

Since this controversial public display of affection, Malawi has been abuzz with regards to the nature and length of the kiss in a controversy I dub ‘kissgate’.

Some of Malawi’s social media communities have been particularly harsh on Mutharika. Critics have argued that the President should not have kissed in wife in public because it was contrary to Malawian culture. They called the act of public kissing a “taboo” and have made references to it as evidence of moral corruption and cultural erosion in Malawi. They argued that kissing in public was something that was ‘unMalawian” and stemmed from Western values. Adding to the accusations that it was not Malawian, his decision to wear a Chinese suit was also came under attack.


As others scrutinized photos or replayed the video of the kiss, they argued that the kiss itself was alright but that the use of the presidential tongue in kissing for television was the real issue at hand. They argued that using ones tongue to kiss ones wife was not befitting for the highest office in the land and called it “disgusting”. They would have preferred that the President gave his wife a peck on the lips at such a function rather than what they perceived was a French kiss, which indicates an overt sexual act. Detractors alluded that his kiss that was too long, too fervent and hence, sloppy. One such commentator on the Nyasatimes was so disturbed and agitated by the presidential couple’s kiss that he opined, “Get a room you slobbering, couthless (sic) nincompoops!”

Many others were further irked by the accompanying comments that President Mutharika made to his wife during the presentation of the flower: “on this special day, I want to say thank you! Thank you for always being there for me through the frights and the cold nights….” The references to ‘cold nights’ were highly problematic for the country’s conservative citizens who would have rather have had that conversation relegated to the bedroom and not a public event.

Others on social media took it as an opportunity to use it as a platform to comment on his overall performance as a president. Chakwanuleka notes that “This fellow is a non performer (sic) and this is what he can do best”. More serious economic connections were also made in relation to who paid for the flowers and the party event. A few commented that regardless of who paid for it, holding such a lavish event in the middle of an on-going national flood disaster was insensitive.

Not everyone of course was against the president’s actions. Some Malawians were  content that on this Greco-Roman Holiday, Malawian President Peter Mutharika kissed his wife French style in a Chinese suit. After all, are we not living in a globalized era where cultures cross? His supporters state that kissing in public was  no more “unMalawian” than “wearing clothes” or doing anything we want to wrongly label “Western”. Others argued that it gave the President more of a human face and applauded him for being down to earth. They called it a “romantic” gesture on his part. Many suggested that it was a good move on his part to be able to show respect for his wife in this way. They argued that it would encourage other Malawian men to show affection and commitment to their wives in public as well.

The district administration here today launched a career counselling app which will put job alerts for people having educational qualifications of various levels.
During the launch of the app, Deputy Commissioner KK Yadav said as a majority of the youths used mobile nowadays, the app would prove beneficial to those looking for jobs.
He said the app could be downloaded free of cost from the Google playstore.
He also said that around 100 model career counselling centres were established in various schools in the district.

The app, besides giving information on job alerts, will also give information about various careers and their required qualifications.
It will have a wide variety of job openings for class X, XII and graduates. Many officials of the administration were present on the occasion.

But sometimes "doing" gets in the way because you get so wrapped up in what you have to do and you miss why you are doing it in the first place. "Doing" is good, but not if it keeps "being" out of the loop.

When you give yourself time to "be" you are able to gain focus and insight. When you're on overdrive, pushing becomes a way of life and you lose yourself. You get so caught up in your goals that you forget why you created those goals. Usually we rush towards something to get answers. Rushing won't provide the answers you are seeking, "being" will.

Thinking is important because it gives your mind the outlet it needs to run well. Thoughts can only stay bottled for so long. Then, they need to be channeled somewhere. The amazing thing about your thoughts is they belong to you and only you. And when you take the time to listen, what you need to do next comes from you. Making time to think allows the real you to get out; a person you may want to get to know again.

Re-Choose Your Goals

As the days, weeks, and months go by, momentum slows down when we are trying to reach our goals. What once were goals that were inspiring, became hard work and frustration over time. This frustration you are feeling means it's time to reconnect with what's important to you.

Why did you choose your career goals initially? Did you choose them because they inspired you? If yes, remember that time you made your choice. Remember when you felt hopeful, excited, and optimistic. Tap into that feeling again and use it to get back on track in a more powerful, calmer, and empowering way. If you choose your goal because you felt you had no choice, reevaluate this choice. Choose your goals not because they've become something you "should" do, but because they are important to you.

The most common mistake that many beginning real estate investors make is that they pay too much for property. Fact is overpaying for property is often cited as the number one reason why so many newcomers fail to make it as profitable real estate investors. That's because most beginning real estate investors are woefully undercapitalized, and they don't have the deep pockets that are needed to subsidize their overpriced real estate investments.

For many neophyte investors, paying too much for their first investment property usually proves to be a very costly and fatal mistake, and marks the beginning of the end of their foray into real estate. That's why it's imperative that you learn how to accurately estimate the current market value of potential investment properties! As far as I'm concerned, it's the single most important aspect of the entire real estate investment business!

A Fast $15,000 Profit for Knowing the Value of a Condemned House

I once bought a real estate option on a filthy, neglected, run-down, but structurally sound house in a neighborhood-in-transition in Winter Park, Florida, a suburb of Orlando, that had been condemned for building, safety, health and fire code violations. This place looked like something right out of downtown Baghdad, Iraq! It had what code enforcement inspectors commonly refer to as accumulations of every type of debris, garbage and junk known to mankind! The property's owner lived in Westerville, Ohio, and wanted the steady stream of threatening letters from the Winter Park Code Enforcement Board to stop.

I had done my homework, and knew the property was worth at least $110,000 after it was cleaned up. I ended up paying $500 for a one-year option to purchase the house for $75,000. It cost me $2000 to have all of the accumulations removed from the property, and the house, driveway and walkways pressure washed. Three weeks later, I sold my real estate option agreement for a $15,000 profit! This never would have happened if I had been clueless about how to estimate property values. Since I had an accurate estimate as to how much the property was worth in its current condition, I was able to negotiate a below market purchase price that was based on the property's filthy, neglected, run-down non-marketable condition, and not on how much it might have been worth after it had been cleaned up.

The Definition of Market Value

The Appraisal Foundation's Uniform Standards of Professional Appraisal Practice, defines market value as: "The most probable price a property should bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller each acting prudently and knowledgeably, and assuming the sale price isn't affected by undue stimulus.”

The Difference Between Assessed Value and Appraised Value

The difference between a property's tax-assessed value and its appraised value is as follows:

1. Tax Assessed Value: Tax-assessed value is the value established by the local taxing authority for a parcel of land and the improvements placed upon the land for property tax purposes. For example, in Florida, owner-occupied single-family houses are generally assessed at around seventy percent of their fair market value by county property appraisers.

2. Appraised Value: Appraised value is the value estimate given to a property by a licensed property appraiser using accepted appraisal methods for the type of property being appraised. For example, the accepted appraisal method to accurately estimate the fair market value for an owner-occupied single-family house is the comparison sales method where a property's value is based on the recent sale of comparable properties within the same area.

The Three Common Methods Used to Estimate Property Values

The three most common methods used by property appraisers to estimate property values are the:

1. Comparison Sales Method: The comparison sales method bases a property's value on the recent sale prices of properties that are within the same area and comparable in size, quality, amenities and features.

2. Income Method: The income method is used to estimate the value of an income producing property based on the net income the property produces.

3. Replacement Cost Method: The replacement cost method is based on what it would cost to replace the improvements on property using similar construction materials and construction methods.

The Comparison Sales Method of Estimating a Property's Value

The comparison sales method of estimating a property's value is based on the recent sale prices of properties within the same area that are comparable in size, amenities and features. In order to be accurate, sale price adjustments must be made for comparable properties that have been sold at unrealistically low prices or on overly favorable financial terms not readily available to the buying public.




The Income Method of Estimating a Property's Value

The income method is used to estimate the value of an income producing property based on the net income the property produces. Under the income method value is calculated using a:

1. Capitalization Rate. The capitalization rate, or cap rate, is calculated by dividing a property's annual net operating income by its purchase price.

2. Gross Rent Multiplier. The gross rent multiplier, or GRM, is calculated by dividing the purchase price by the property's monthly gross operating income.

Watch Out for Owners Using Fuzzy Math

A word to the wise: when you read a property's income and expense statement, you should always go under the assumption that the owner is probably practicing fuzzy math by fudging on the numbers, and telling little white lies to back them up. Also, use a monthly income and expense analysis worksheet like the sample copy below, to cross-check everything that's listed on a property's income and expense statement in order to reconcile the statement with receipts and tax returns against what's shown on:

1. Schedule E (Supplemental Income and Loss) of the owner's latest federal income tax return.

2. The property's latest annual tax assessment income and expense statement on file at the county property appraiser or assessor's office.

3. All of the rental agreements for the past year.

4. Water, sewage, solid waste, gas and electric bills for the past year.

5. Repair and capital improvement bills for the past year.

The Replacement Cost Method of Estimating a Property's Value

The replacement cost method of estimating a property's value is based on the cost of replacing the improvements on the property minus the cost of the land to estimate a property's value. Replacement costs are calculated on a per square foot basis by dividing the total number of square feet in the building by the per square foot construction cost. For example, a two thousand square foot convenience store that cost $375,000 to build would have a replacement cost of $187.50 per square foot, $375,000 divided by 2000.

The back cover screams this question at the reader with the preamble concluding that this book by Ajay Kansal deals with establishing the fact that anthropologies and histories lead to one conclusion – mankind created gods!

The writer starts off with a very arresting question in the preface – Why are there many religions but only one science on the earth and you would expect a atheist’s rant coming along in the next 200 odd pages. But he surprises with the balance and poise of his argument with never the book turning onto an anti-theist track. Ajay Kansal takes us along on the journey of the evolution of mankind from the nomadic human to the agriculturist to the social animal by tracing his religious evolution.

He tells us that the religious journey of man began right in his nomadic days with abundant mysteries of nature boggling him scared like night, animals, pregnancy, ghosts, etc. This fear of man gave birth to the concept of a superhuman somewhere with immense powers – the very concept of god. Nomadic man began worshipping the things that relived him from his fears – Fire, Sun and Sky and thus began nature worship. Later with him turning to agriculture the fear of food scarcity came in and with it developed the fertility cult – the worship of the goddess. Agriculture led to settlements that led to diseases, which proved another mystery for human minds, and up came the concept of a punishing god – The Yahweh of Judaism. The beliefs were prominent that diseases are punishments from the super power and ways to please the punishing god were sort out which led to the barbaric practice to sacrifices – human and animal. With the punishment culture settling in, came the problems of cruelty, injustice and exploitation which it required some relief. This requirement of mankind gets fulfilled in the form of a kind merciful god – Jesus of Christianity. While this was the story of the western side of the globe the eastern side too underwent similar change patterns with fire, sky and sun worships being followed in the name of yagnas leading to only affluent strata’s of the society understanding worships and gods. The need was simplification of religion and a prince-turned-ascetic is the answer – Buddha of Buddhism. With a major part of the population understanding and following Buddhism the priests of the earlier practiced religion of the land – Hinduism revamp the teachings to revolve around thousands of gods and millions of folklores about the gods, getting it back to be the favorite of the people.

Ajay Kansal has written an excellent book about the religious evolution of mankind filled with historical facts and scientific proofs. There is hardly any invalid talk that is not supported by hard facts concerning the discussion. Be it the proof of first human burials at Skhul caves in Israel or talk of a solar cult, with the Stonehenge in England and Konark in India as proofs of its existence, he talks in facts. While he talks about the temple snake healers in Greece, he also questions on why only domesticated animals like bull or goat were offered to the gods in sacrifice by priests; why not a tiger? He challenges the reader to question beliefs and rituals not for the faith but for their authenticity and need. He emphasizes that the creator for mankind is not god but ‘fear’ – fear creates gods and still keeps them alive, in spite of all facts and faults. Even while the biggest belief of humanity that diseases are the wrath of the gods, they are the demons possessing humans – something that led to the most gory and barbaric practices by mankind, the witch hunting episodes of the west and human sacrifices of the east – lays shattered owing to scientific advancements, modern fears still keeps the gods thriving.

A work that talks so well based on facts, is weakened some what in narration by the writer’s continuous projection of priests of every religion, in every era as clever self-centered beings who created gods, rituals, traditions etc. for more selfish reasons than social ones. Also the writer being a doctor and Hindu unwittingly emphasizes more on the chapters dealing with diseases and Hinduism, which form the two longest chapters in the book while an equal depth in other areas is missing.

Not one of the best books on the subject but a very decent one for overall understanding of Religious Evolution of Mankind which moved from new problems to new gods to new religions.

By this petition purported to have been filed under Article 32 of the Constitution of India, 1950 (in short 'the Constitution') prayer is to
declare Section 498a of Indian Penal Code, 1860 (in short 'the IPC') to be unconstitutional and ultra vires in the alternative to formulate
guidelines so that innocent persons are not victimized by unscrupulous persons making false accusations.
2. Further prayer is made that whenever, any court comes to the conclusion that the allegations made regarding commission of offence under
Section 498a IPC are unfounded, stringent action should be taken against person making the allegations. This, according to the petitioner, would
discourage persons from coming to courts with unclean hands and ulterior motives. Several instances have been highlighted to show as to how
commission of offence punishable under Section 498a IPC has been made with oblique motives and with a view to harass the husband, in-laws and
relatives.
3. According to the petitioner there is no prosecution in these cases but persecution. Reliance was also placed on a decision rendered by a
learned Single Judge of the Delhi High Court wherein concern was shown about the increase in number of false and frivolous allegations made. It
was pointed out that accusers are more at fault than the accused.
Persons try to take undue advantage of the sympathies exhibited by the courts in matters relating to alleged dowry torture.
4. Section 498a appears in Chapter XXA of IPC.
5. Substantive Section 498a IPC and presumptive Section 113B of the Indian evidence Act, 1372 (in short 'evidence Act') have been inserted in
the respective statutes by Criminal Law ( Second Amendment) Act, 1983.
6. Section 498a IPC and Section 113B of the evidence Act include in their amplitude past events of cruelty. Period of operation of Section
113B of the evidence Act is seven years, presumption arises when a woman committed suicide within a period of seven years from the date of
marriage.
7. Section 498a reads as follows:
"498a: Husband or relative of husband of a woman subjecting her to cruelty- Whoever, being the husband or the relative of the husband of a
woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to
fine.
Explanation - For the purpose of this section 'cruelty' means -
(a) any wilful conduct which is of such a nature as is likely to drive the woman to commit suicide or to cause grave injury or danger to life,
limb or health whether mental or physical of the woman; or
(b) harassment of the woman where such harassment is with a view to coercing her or any person related to her to meet any unlawful demand for
any property or valuable security or is on account of failure by her or any person related to her to meet such demand."
Section 113B reads as follows:-
"113B: Presumption as to dowry death- When the question is whether a person has committed the dowry death of a woman and it is shown that soon
before her death such woman has been subjected by such person to cruelty or harassment for, or in connection with, any demand for dowry, the
Court shall presume that such person had caused the dowry death.
Explanation - For the purposes of this section 'dowry death' shall have the same meaning as in Section 304B of the Indian Penal Code (45 of
1860)."
8. Consequences of cruelty which are likely to drive a woman to commit suicide or to cause grave injury or danger to life, limb or health,
whether mental or physical of the woman is required to be established in order to bring home the application of Section 498a IPC. Cruelty has
been defined in the explanation for the purpose of Section 498a. It is to be noted that. Sections 304B and 498a, IPC cannot be held to be
mutually inclusive. These provisions deal with two distinct offences. It is true that cruelty is a common essential to both the Sections and that has
to be proved. The explanation to Section 498a gives the meaning of 'cruelty'. In Section 304B there is no such explanation about the meaning
of 'cruelty'. But having regard to common background to these offences it has to betaken that the meaning of 'cruelty' or 'harassment' is the
same as prescribed in the Explanation to Section 498a under which 'cruelty' by itself amounts to an offence.
9. The object for which Section 498a IPC was introduced is amply reflected in the Statement of Objects and Reasons while enacting Criminal Law
(Second Amendment) Act No. 46 of 1983. As clearly stated therein the increase in number of dowry deaths is a matter of serious concern. The
extent of the evil has been commented upon by the Joint Committee of the Houses to examine the work of the Dowry Prohibition Act, 1961. In some
cases, cruelty of the husband and the relatives of the husband which culminate in suicide by or murder of the helpless woman concerned, which
constitute only a small fraction involving such cruelty. Therefore, it was proposed to amend IPC, the Code of Criminal Procedure, 1973 (in
short 'the Cr.P.C.') and the evidence Act suitably to deal effectively not only with cases of dowry deaths but also cases of cruelty to married
women by the husband, in-law and relatives. The avowed object is to combat the menace of dowry death and cruelty.
10. One other provision which is relevant to be noted is Section 306 IPC. The basic difference between the two Sections i.e. Section 306 and
Section 498a is that of intention. Under the latter, cruelty committed by the husband or his relations drag the women concerned to commit
suicide, while under the former provision suicide is abetted and intended.
11. It is well settled that mere possibility of abuse of a provision of law does not per se invalidate a legislation. It must be presumed,
unless contrary is proved, that administration and application of a particular law would be done "not with an evil eye and unequal hand" (see: A.
Thangal Kunju Musaliar v. M. Venkatachalam Potti, Authorised Official and Income-Tax Officer and Anr.)
12. In Budhan Choudhry and Ors. v. State of Bihar a contention was raised that a provision of law may not be discriminatory but it may land
itself to abuse bringing about discrimination between the persons similarly situated. This court repelled the contention holding that on the
possibility of abuse of a provision by the authority, the legislation may not be held arbitrary or discriminatory and violative of Article 14 of
the Constitution.
13. From the decided cases in India as well as in United States of America, the principle appears to be well settled that if a statutory
provision is otherwise intra-vires, constitutional and valid, mere possibility of abuse of power in a given case would not make it objectionable,
ultra-vires or unconstitutional. In such cases, "action" and not the "section" may be vulnerable. If it is so, the court by upholding the
provision of law, may still set aside the action, order or decision and grant appropriate relief to the person aggrieved.
14. In Mafatlal Industries Ltd. and Ors. v. Union of India and Ors., a Bench of 9 Judges observed that mere possibility of abuse of a
provision by those in charge of administering it cannot be a ground for holding a provision procedurally or substantively unreasonable. In Collector of
Customs v. Nathella Sampathu Chetty (1962 (3) SCR 786) this Court observed:
"The possibility of abuse of a statute otherwise valid does not impart to it any element of invalidity." It was said in State of Rajasthan v.
Union of India "it must be remembered that merely because power may sometimes be abused, it is no ground for denying the existence of power.
The wisdom of man has not yet been able to conceive of a Government with power sufficient to answer all its legitimate needs and at the same
time incapable of mischief." (Also see: Commissioner, H.R.E. v. Sri Lakshmindra Thirtha Swamiar of Sri Shirur Meth (1954 SCR 1005).
15. As observed in Maulavi Hussein Haji Abraham Umarji v. State of Gujarat. Unique Butle Tube Industries (P) Ltd. v. U.P. Financial
Corporation and Ors. and Padma Sundara Rao (dead) and Ors. v. State of Tamil and Ors., while interpreting a provision, the Court only interprets the law
and cannot legislate it. If a provision of law is misused and subjected to the abuse of the process of law, it is for the legislature to amend,
modify or repeal it, if deemed necessary.
16. The judgment of the Delhi High Court on which reliance was made was rendered in the case of Savitri Devi v. Ramesh Chand and Ors. In that
case while holding that the allegations regarding commission of offence punishable under Section 498a IPC were not made out. Certain
observations in general terms were made about the need for legislative changes.
The complainant had moved this Court against the judgment on merits in SLP(Crl)......of 2003 entitled Savitri Devi v. Ramesh Chand and Ors. By
order dated 28.11.2003 this Court observed, as follows:
"Heard learned counsel for the petitioner.
Delay condoned.
We do not see any merit in the challenge made to the order of the High Court in Criminal Revision No. 462 of 2002, on the facts of the case.
The special leave petition is, therefore, dismissed.
At the same time, we express our disapproval of some of the generalized views expressed in paragraphs 23 to 32 of the judgment of the High
Court by the learned Single Judge. The learned Judge ought to have seen that such observations, though may be appropriate for seminars or
workshops, should have been avoided being incorporated as part of a court judgment. Some of the views also touch upon Legislative measures and wisdom
of legislative policy in substance, which according to the learned Judge need to be taken into account. There was no scope for considering all
such matters in the case which was before the learned Judge. It is, therefore, appropriate that such generalized observations or views should
meticulously avoided by Courts in the judgments."
17. Above being the position we find no substance in the plea that Section 498a has no legal or constitutional foundation.
